The "city" closest to me is trying to ban smoking in a similar way. While it suits the heck out of me for them to ban smoking (I hate the smell of smoke, and for fairness' sake, allowing it is like allowing drunks to piss on your head), I hate that this means that people who own diners or restaurants or nightclubs can't let people light up in their own building. So much for property rights. "If you don't like my smoke-filled bar, I don't want you anyway!" should be the rule here.
It's yet another freedom being infringed upon because the movers and shakers in politics (the people with money, specifically the health-care industry) have a beef with it (because of the money spent to care for lung-cancer patients), and people are too dumb to stop killing themselves with nicotine and tar on their own.
